WHAT IS THIS LICENCE FOR?

This optional licence upgrade extends the amount of recordings (of your performance) that you can legally distribute. This particular licence is only sold in addition to your currently active ‘Digital Publication’ – it does not replace it. Your current annual licensing (which can only be obtained from an active ‘Digital Publication’ or ‘Complete Pack’ where available) allows you to distribute your recordings to no more than 50 units / users (conditions apply). The recording licence upgrade on this page allows you to extend that amount to more than 50 units/users.

HOW TO ORDER & PUBLISH

1. IMPORTANT: Please read this entire page (including all tabs) before ordering, or publishing.
2. Select the category of licence you wish to purchase (see below for category definitions).
3. ‘Add to Basket’.
4. During checkout, in the ‘Order Notes’ section, please type in the name of the single Learn2soar publication that this licence will cover, and the name/details of the performing organisation and venue, if these details are not featured in the billing/shipping address fields.
5. Complete checkout and you’re covered. UK schools can also use the same checkout function to pay via school invoice.
6. ONLINE USE: If you are uploading your performance to allow online viewing, then your video MUST BE PASSWORD PROTECTED in some way, so that it can only be accessed by your staff, pupils and their families. You are not allowed to place your video openly on the internet via YouTube / Facebook etc, or through an unprotected area of your website. If you do, then we will have it removed as a breach of copyright and you may be fined depending on the seriousness of the breach.
7. OFFLINE USE: If you are placing your recording onto hard media (e.g. DVD / USB) then please contact us for the special copyright wording that needs to be added to each copy of your distributed media.

In addition to the above, other terms and conditions still apply to your recording / distribution, and we advise you to carefully read this entire page including all tabs, in order to avoid any issues arising.

FREE: Recording Licence Category ZERO – Allows distribution for up to 50 Users/Units – this category of use is automatically included with your annual subscription to the ‘Digital Publication’ (or ‘Complete Pack’ where available). Please note that with this category of licence, as with all the others, you must still follow the full advice found on this entire page before publishing your recordings to avoid issues.

UNITS / USERS – DEFINITION

UNITS: This is for customers producing physical items like CDs/DVDs/USB sticks. E.g. each single DVD produced is one unit.

USERS: This is for customers who are distributing their video recording online via pre-recorded video or livestream, via a private / protected stream only. (Non-protected distribution via YouTube etc is NOT permitted). The amount of ‘Users’ is your best estimate of the amount of families watching your video/stream. This is best done by totalling the number of children in your cast, minus any siblings in the same family unit. We do not expect you to count individual watchers or different devices. Just count each family/household as one user.

SUBSCRIPTION REQUIRED: Before recording or distributing any performance, you must firstly be in possession of a valid ‘Performance Licence’ issued by Learn2soar Music. This applies worldwide. Licenses issued by any other organisation do not apply. A Performance Licence is always required whenever any type of performance takes place, even when the audience is watching the performance via any remote device. As of August 2022, our performance licences are only available via an up-to-date annual subscription to the relevant ‘Digital Publication’ (or ‘Compete Pack’ where available). Therefore, you must have an active subscription in place before recording takes place.

ONLINE – SECURE DISTRIBUTION ONLY: If you are making your recording available online via pre-recorded video or live stream, then the video/stream must be password protected somehow. Either by using a password protected video, or a password protected webpage, or via a secure area of your website with limited access. This is so your video can only be accessed by your intended audience and isn’t accidentally made freely available for anyone in the world to access it, which would mean vastly increased licence costs and charges for you. However, we do allow you to post very short clips of your performance via social media as long as you tag us in (see below for further details). You are forbidden from posting anything more than ‘short clips’ of your performance online in any unsecured way, including for example to Facebook or YouTube, or on an unprotected area of your website. If you do, then we will have the content removed as a ‘breach of copyright’, which could have damaging consequences for your organisation’s online presence. If you are in any doubt as to your usage please contact us before publishing your recording. We are very happy to provide advice for alternative solutions if required.

OFFLINE – PHYSICAL DISTRIBUTION:  If you are creating physical DVDs/CDs for distribution, then there is special copyright wording that needs to be printed on each copy you produce. Please contact us for the exact wording to use on your products. Thank you.

YOUR PERFORMANCE ONLY: You can only distribute recordings of your performance, where your cast’s voices are dominant. Under no circumstances should you ever distribute recordings where the only audio is from our original recordings, or where our recordings are dominant.

LEARN2SOAR CONTENT ONLY: The licences available on this website only cover songs / scripts / material published by Learn2soar Limited. If you include songs or other content from different publishers as part of your performance, then those elements of your performance  / recording cannot be covered by any licensing obtained from us. Therefore, you can either edit the extra content out before performance / distribution, or you can seek additional permissions / licensing from the relevant publishers.

ACCREDITATION: You are not allowed to claim any aspect of any Learn2soar publication as being your own work. Full accreditation should always be given to the writers / publisher wherever possible. With this in mind, you are not allowed to remove the names of writers / publishers from your recordings / distributions. For example, you cannot edit the publication cover image to remove or replace the names of writers. If you do, then we will seek to have the content removed.

SOCIAL MEDIA RULES: Very short clips of your performance are allowed on social media, or on your establishment’s own website, in a non-profit making capacity. Any short clip must be no more than one minute in length, and must also be no more than 50% of any one song, and with no more than 4 clips posted in total – and please do tag us in!

BROADCAST: No recording may at any time be broadcast via film / TV / radio / print media, without the express permission of Learn2soar Limited. If the permission of Learn2soar Limited is obtained for any type of broadcast, then royalties will become due to Learn2soar Ltd. Please contact us for details.

PRIVATE COMPANIES: Re-sale or redistribution of recordings of any of our publications by private individuals / private companies, who are not directly connected with the performing establishment, are not allowed without the express permission of Learn2soar Limited.

LICENSING AGREEMENT: All the above information can be found in your ‘Licensing Agreement’. A copy of your licensing agreement is located within your ‘Digital Publication’. Other licensing terms that are in addition to the information found on this page may still apply to your usage / performance / distribution and it is important that you make yourself aware of the full contents of your ‘Licensing Agreement’ before your usage begins. QUESTION: Do we have to count every device accessing our secured live-stream?
ANSWER: No, there’s no need to count all the devices, even though we know that some households may use up to 3 or 4 devices each. We recognise that could get very messy for you to organise and we want to keep things as simple as possible. Therefore, you only need to count the amount of families watching your live stream. This is best done by totalling the number of children in your cast, minus any siblings in the same family unit.

QUESTION: What if some families watch our secure online video several times over, are you counting the total number of views?
ANSWER: No, we recognise that a lot of families may want to watch several times over and counting this could prove problematic for many of our customers. Therefore, you only need to count the amount of families who are being granted access to your video. This is best done by totalling the number of children in your cast, minus any siblings in the same family unit.

QUESTION: What is the “special wording” to place on DVDs? Where does it go?
ANSWER: There is a line of copyright text that needs to be placed on any DVD / CD / USB that you produce. Each publication has its own specific set of copyright text. This information will be included on your invoice / receipt after you have ordered your ‘Recording Rights Licence’. If it turns out that you qualify for a free recording rights licence, please email us with your details and we’ll send you the information you need. As for where it goes, that’s up to you. We would prefer it to be printed on the media itself, or failing that, we’d like it to be printed on the sleeve or cover. However, we know this isn’t possible for every customer, therefore, as a last resort, we’re happy for it to be printed on an additional letter or slip accompanying the media.

QUESTION: Can we purchase this licence after we’ve sold / distributed our recording? So that we know the exact numbers involved?
ANSWER: Sorry, but no. Our terms and conditions state that any licence needs to be purchased before the terms of use come to fulfilment, not afterwards. Please do not worry too much about the precise numbers involved. Your ‘best guess’ will usually suffice. However, in the eventuality that the final numbers distributed are far higher than the numbers previously given then we reserve the right to charge additional fees.

QUESTION: Do we need to renew our recording licence every year?
ANSWER: Only, if you want to carry on distributing recordings again, or if an online video was posted in the first year, and you want to keep it online for longer. To clarify further, each recording licence is sold for a 12 month term only. Once this annual recording licence expires, you will need to order a new recording licence from this page, but only if you wish to distribute recordings of one of our publications again.

QUESTION: Can we put our video on YouTube or Facebook?
ANSWER: No. We insist that any recording of your performance going online is password protected in some way, so that it can only be accessed by your intended audience. Neither Facebook nor YouTube have a password protect setting. Facebook let you limit the views to ‘friends only’, but this doesn’t always reflect your intended audience and could make your licence more expensive than it needs to be. YouTube do have a ‘private video’ setting, which you’re welcome to try, but it is hidden away in the YouTube account settings and can be very complex to use as it requires you to manually type in the email addresses of everyone who you want to view the video. Therefore, we don’t recommend using YouTube for this purpose
However, you can place unprotected short clips of your performance on YouTube or social media (no more than one minute in length / no more than 50% of any one song / no more than four clips altogether).
So what are the alternatives? Instead of placing your whole performance on YouTube or Facebook, we recommend that you contact the people who manage your organisation’s website, as creating a password protected page on your website is actually a lot easier than it sounds and they should be able to help you. Failing that,  if you’re still stuck for ways to display your recording online, then feel free to contact us as we can host it for you on a private page on our website, for a reasonable charge. We can even provide the means for you to offer a ‘buy-and-keep’ option to your families, so that they can pay to retain a copy – helping you to do a bit of fund-raising! QUESTION: Why the big issue with ‘password protection’, and ‘online secure’ videos only. What’s wrong with publishing the whole video to YouTube?
ANSWER: 1. YouTube and similar online platforms only allow you to post content that you own the copyright to, or that you have specific permission for. You do not own the copyright to any of our publications, and we do not give permission for non-secure videos of any performance of our works to be openly posted online. 2. With advances in technology and AI, it is now easier than ever to have an entire video of a theatrical work transcribed automatically, even including sheet music. Thereby providing a means for dishonest individuals to illegally copy our work with minimum effort. We cannot allow this, and will therefore always insist on the complete removal of any unauthorised content.
